$2.5M Settlement from Motorcycle Crash

The plaintiff became paralyzed from the waist down after he lost control of his motorcycle, crossing into oncoming traffic and hitting a truck head on. The plaintiff sued the dealership for the ordeal citing that they did properly inspect the motorcycle before selling it to him and that he lost control due to a malfunction. The dealership’s rebuttal cited that the plaintiff was simply an inexperienced driver and had lost control of the motorcycle and only had himself to blame for the crash.

The team argued that a 56-point inspection of the motorcycle had not been done by the dealership prior to selling it to Hall. This is an industry-standard that must be done on all motorcycles before they leave the dealership with their new owners.

An engineer from St. Louis was able to conclude that markings on the steering bearings indicated that the bearings were loose and were in need of adjustment. The steering bearings are included in the 56-point inspection and were clearly overlooked.

The drivers of the truck were also able to confirm that the plaintiff’s motorcycle was shaking uncontrollably as to what they referred to as a “death shake” to the point where the plaintiff’s hands came off the handlebars prior to the accident.

The defendant has since decided to settle the case at 2.5 million dollars.
